These Terms of Service govern access to and use of fishingtheshallows.com and purchases from Fishing The Shallows LLC. By visiting the website, creating an account, placing an order, or otherwise using the website, you agree to these Terms.

2. ELIGIBILITY

You must be legally capable of entering into a binding agreement in your jurisdiction to place an order. If you use the website on behalf of a business or another person, you represent that you have authority to bind that party to these Terms.

 

3. PRODUCT INFORMATION AND MOCKUPS

We make reasonable efforts to describe and display products accurately. Product photographs and mockups are provided for visual reference and are not necessarily shown to scale. Garment colors, artwork colors, placement, and appearance may vary because of monitor settings, device displays, lighting, garment dye lots, garment sizes, available print areas, and production processes.

 

Where applicable, back artwork has a maximum image measurement of 10 inches by 12.4 inches. Not all designs will use that maximum size because final artwork dimensions depend on the design. Front logos generally measure 4 inches by 2.7 inches.

 

Minor variations that do not materially change the product are not defects. Nothing in this section limits rights that cannot be waived under applicable law.

 

4. ORDERS AND ORDER ACCEPTANCE

An order confirmation acknowledges that we received an order; it does not guarantee acceptance or shipment. We may refuse, limit, or cancel an order for reasons including suspected fraud, payment problems, incorrect pricing, product unavailability, address issues, policy violations, or errors in product information.

 

If we cancel a paid order, we will refund the amount charged for the cancelled portion to the original payment method.

 

You are responsible for reviewing product selections, sizes, colors, quantities, personalization, contact information, and delivery information before submitting an order.

 

5. PRICES AND PAYMENT

Prices are displayed in United States dollars unless otherwise stated. Taxes, shipping charges, and other applicable charges are shown at checkout when available. We may correct pricing or product-information errors before shipment. Payment must be successfully authorized before an order is processed.

 

6. CANCELLATIONS, FINAL SALE, AND REPLACEMENTS

Printed products are final sale, subject to the separate Refund, Cancellation, and Replacement Policy. Cancellation requests must be received within 24 hours after purchase. Products are not eligible for return, exchange, or refund because of change of mind, incorrect size or color selection, or personal preference after the cancellation period.

 

The final-sale rule does not limit legally required remedies for unshipped orders or products that arrive damaged, defective, incorrect, or materially different from their description. Damage-related claims must be submitted by email to sales@fishingtheshallows.com with photographs and are not processed by telephone.

 

7. SHIPPING

We currently ship only to the contiguous United States. Production, processing, delivery estimates, tracking, delays, and address issues are governed by the separate Shipping Policy, which is incorporated into these Terms.

 

8. INTELLECTUAL PROPERTY

All original and commissioned content associated with Fishing The Shallows LLC and fishingtheshallows.com, including shirt designs, apparel artwork, illustrations, graphics, logos, emblems, slogans, phrases, product and collection names, mockups, photographs, videos, website copy, page layouts, branding elements, and other creative materials, is owned by or licensed to Fishing The Shallows LLC and is protected by copyright, trademark, trade dress, and other intellectual-property laws.

 

Purchasing a product gives the purchaser ownership of that physical product only. It does not transfer or license any copyright, trademark, design right, reproduction right, manufacturing right, or other intellectual-property right in the artwork or branding displayed on the product.

 

Without prior written permission from Fishing The Shallows LLC, you may not copy, reproduce, trace, redraw, digitize, modify, adapt, manufacture, print, sell, offer for sale, distribute, publish, upload, scrape, extract, create derivative works from, or commercially exploit any protected design or content. You also may not remove ownership notices, use our content to train or develop a commercial model or dataset, or use our branding in a manner that falsely suggests sponsorship, affiliation, or approval.

 

Limited sharing of product-page links or unmodified public promotional images for personal, noncommercial purposes is permitted when the source is clearly identified and the content is not altered or used to sell competing or unauthorized products.

 

9. ACCEPTABLE USE

You may not use the website to violate any law; infringe intellectual-property or privacy rights; submit false or misleading information; transmit malicious code; interfere with website security; scrape or harvest data without permission; impersonate another person; commit fraud; or engage in conduct that could damage the website, the business, or other users.

 

10. ACCOUNTS AND SECURITY

If account features are available, you are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account. Notify us promptly if you believe an account has been accessed without authorization.

 

11. THIRD-PARTY SERVICES AND LINKS

The store is hosted on Shopify and may use third-party payment, fulfillment, shipping, analytics, marketing, and other service providers. Third-party sites and services are governed by their own terms and privacy practices. We are not responsible for third-party content or services except to the extent required by applicable law.

 

12. DISCLAIMERS

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. We do not guarantee uninterrupted, error-free, or completely secure access. Product warranties, if any, are limited to those expressly stated in writing.

 

These disclaimers do not exclude warranties, remedies, or consumer rights that cannot legally be excluded.

 

13. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Fishing The Shallows LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or purchase of products. Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by law.

 

This limitation does not apply where prohibited by law or to liability that cannot legally be limited.

 

14. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Fishing The Shallows LLC and its owners, personnel, contractors, and service providers from third-party claims resulting from your unlawful misuse of the website, violation of these Terms, or infringement of another party’s rights.

 

15. PRIVACY

Personal information is handled in accordance with our Privacy Policy. Shopify and other service providers may also process information under their own privacy terms.

 

16. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where another law must apply. Nothing in these Terms deprives a consumer of protections that cannot be waived.

 

17. SEVERABILITY AND WAIVER

If any provision is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

 

18. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless applicable law requires otherwise.
